- "Company" refers to Elite Shades, the sole provider of window covering products and services.
- "Client" refers to the individual or entity purchasing goods or services from the Company.
- "Goods" means all window coverings, blinds, shades, and associated products supplied.
- "Services" means all measuring, quoting, installation, and consultation services provided.
2.1 All quotes provided are valid for 30 days unless otherwise stated in writing.
2.2 Quotes are based on the information provided at the time of assessment. Any changes may result in a revised quote.
2.3 Pricing may be adjusted in the event of supplier cost increases, errors, or omissions.
2.4 Acceptance of a quote constitutes acceptance of these Terms and Conditions.
2.5 The Company's service area is Christchurch and the Waimakariri District. Jobs outside this area may still be considered in a case by case basis.
3.1 Measurements taken by the Company are considered final. If the Client provides measurements, the Company is not liable for incorrect fit or additional costs.
3.2 Measurements taken by the company do not need to be provided to the client.
3.3 The Client must ensure clear and safe access to all installation areas.
3.4 If the site is not ready or accessible at the agreed time, a call-out or rescheduling fee may apply.
3.5 Installation dates are estimates only. The Company is not liable for any delay due to weather, supplier issues, or unforeseen circumstances.
3.6 Electrical or structural modifications are not included unless specified. The Company is not liable for damage to hidden wiring, plumbing, or building structure unless caused by gross negligence.
4.1 A deposit of 50% is required upon acceptance of the quote. Balance is due upon completion of installation.
4.2 Goods remain the property of the Company until full payment is received.
4.3 Late payments may incur a fee of 2% per month and may be referred to a debt collection agency at the Client's cost.
4.3 Failure to pay will result in legal action being taken. The Company reserves the right to recover any expenses, disbursements, and legal costs associated with any collection action incurred, including any reasonable solicitor's fees or the actual debt collection agency fees, that may be required should the job not be paid in full by the due date.
5.1 As all goods are made-to-order, cancellations are not accepted once manufacturing has commenced.
5.2 Deposits are non-refundable once production has begun or materials have been ordered.
5.3 Refunds will only be issued in accordance with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
6.1 All products come with a manufacturer's warranty (typically 1-5 years, specifics provided upon request).
6.2 Installation workmanship is guaranteed for 12 months from the date of completion.
- Misuse, modification, or improper cleaning of products
- Normal wear and tear, fading, or discolouration
- Product failure due to water damage, mould, humidity, or pest infestation - Indirect, incidental, or consequential damages
6.4 The Client acknowledges that blinds/shades may have minor variations in color, texture, or weave consistent with manufacturing tolerances.
7.1 The Client grants full access for all agreed works. Any delays caused by restricted access may incur additional fees. 7.2 The Client is responsible for securing pets, valuables, or sensitive areas.
7.3 The Company is not responsible for existing damage or defects in the structure or fittings.
7.4 The Company will take reasonable care, but shall not be liable for accidental damage to paint, walls, or fittings during normal installation.
8.1 By accepting these Terms and Conditions, the Client consents to Elite Shades taking photographs of the completed blinds installation at the Client’s property.
8.2 These photographs may be used by Elite Shades for commercial purposes, including but not limited to social media, advertising, website content, and promotional materials.
8.3 Elite Shades will only photograph the finished product (the blinds) and will do its best to not capture any sensitive areas of the Client’s property.
8.4 If the Client has any concerns about photography or image use, they must notify Elite Shades prior to installation.
